On the go: Trustees of the Airways Pension Scheme have been given permission to use scheme assets to fund an appeal to the Supreme Court over APS discretionary increase litigation.
In 2018, the Court of Appeal ruled that the trustees of the APS went beyond their remit in granting a 0.2 per cent discretionary increase to members’ pensions in 2013.
In December 2018, the trustee requested permission from the court to use scheme assets to fund the appeal and meet British Airways’ costs should an appeal be unsuccessful.
The court released its judgment on Tuesday, approving the use of scheme assets by the trustee to fund an appeal to the Supreme Court, according to a recently published scheme update to members.
The appeal will therefore continue to the Supreme Court, which has been provisionally listed by the Court Registry to start on July 3 2019.
